Full payment is required before any hosting service is rendered, which includes renewals. Soft Architech™ reserves the right to change prices at any time, unless other terms have been agreed upon. Any returned checks for any reason will be subject to a US$25.00 returned check fee plus collection fees if applicable.

All payment-due notices will be sent by electronic mail. No bills or invoices will be sent by postal mail or fax. To avoid any cancellation of your hosting services, please make full payment before the expiry date. All past due accounts will be placed with collections and any additional fees will be the responsibility of the client and may be reported to the appropriate credit reporting agencies if left uncollected.

The cancellation of service must be made in writing with at least three weeks notice. There are no refunds. All sales are final. If the account has a balance due at the time of cancellation, this balance must be paid in full before the account can be cancelled. Cancellation does not absolve the account holder of any outstanding financial obligations. Billing for the account will continue until the balance is paid in full. If the account holder transfers a domain without properly notifying Soft Architech™ they will continue to be charged/billed until the cancellation guidelines have been followed.

We prohibit Spam, or any unsolicited commercial email, from being sent either over the Soft Architech™ network, by customers or any other users of the Soft Architech™ network including customers' customers; and/or over any network. Accounts canceled due to spam will be billed a "clean up" fee.

Soft Architech™ services may be used for lawful purposes only. Transmission, distribution or storage of any material in violation of any applicable laws or regulations is prohibited. Linking to illegal material is also prohibited.

Soft Architech™ will not host the following sites:

• Sites containing pornographic, adult materials, sexual explicit images or links to adult sites
• Sites containing materials that violates the copyright act such as MP3, pirated software, warez, etc.
• Sites containing racism, illegal activities, defamatory remarks
• Sites containing products on hacking, intrusion or violation of security systems
• Spamming or the act of sending bulk unsolicited e-mails to irrelevant groups of people

In addition, we do not allow any of the following without prior written permission from Soft Architech™:

• Running programs in the background on our servers without prior written authorization
• Internet Relay Chat - IRC bots - We do not allow IRC or IRC bots to be operated on our servers.
• Subhosting -hosting more than one web site with a single Soft Architech™ user account is generally not allowed on Soft Architech™ servers.

Any violation of these policies may result in immediate account termination or suspension without prior notification and without any refunds. Any client who violates our policies will be held responsible for any and all damages to Soft Architech™.

Soft Architech™ allows for generous traffic, and most sites never exceed 4 G per month, unless they offer shareware, sound, video, image and multimedia archives, are mirror sites or any site whose primary purpose is file distribution. Soft Architech™ customers are discouraged from storing any files that cause excessive traffic on Soft Archtech™ servers. You will be charged for all transfer that you use beyond our generous data transfer limits without prior notification.

Full backups are made weekly. No guarantees are made of any kind, as to the integrity of these backups. It is the clients' responsibility to maintain local copies of their web content any information.

Soft Architech™ is only responsible to the present owner of the Web hosting space. We verify ownership by credit card number (if paid for by credit card), name, address, email address, username, & password. We are not responsible for any information on your account information to another party who causes damage to your account and/or Web site.

Resellers and their clients are bound by the same policies, guidelines and disclaimers. By reselling and purchasing Soft Architech™ services, you hereby agree that Soft Architech™ shall not be held liable for any promises or failure of same that Reseller's extend to their clients, including but not limited to, quality of service, financial obligations, financial losses or any other claim not provided to reseller in writing by Soft Architech™. It is the legal duty and obligation of the Reseller to provide these policies and guidelines to its clients. If you abuse our services, we reserve the right to cancel your account, which will also cancel your customers’ accounts

Soft Architech™ is not responsible for the privacy practices to whom which we must provide information.

Soft Architech™ shall not be responsible for any claimed damages, including incidental and consequential damages, which may arise from Soft Architech™ servers going off-line or being unavailable for any reason whatsoever. Further, Soft Architech™ shall not be responsible for any claimed damages, including incidental or consequential damages, resulting from the corruption or deletion of any web site from one of Soft Architech™ servers. All damages shall be limited to the immediate termination of service.
